1. Agreement to Terms
By accessing or using the services provided by Crucible Group AI ("CGAI," "we," "us," or "our"), including our website at cruciblegroupai.com and all related AI-powered tools, platforms, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
2. Description of Services
CGAI provides AI-powered business automation, intelligence, and operational systems including but not limited to: AI voice agents, lead generation, competitive intelligence, financial monitoring, content automation, and custom AI infrastructure deployment. Our AI assistant, SARA, and related agents operate as autonomous software systems, not human operators.
3. AI Disclosure & Limitations
- AI-generated content: Outputs from our AI systems (including SARA) are generated by artificial intelligence and may contain errors, inaccuracies, or outdated information. You should independently verify any AI-generated content before making business decisions based on it.
- Not professional advice: Our AI systems do not provide legal, financial, medical, or other professional advice. Consult qualified professionals for such matters.
- Autonomous actions: Some AI agents may take automated actions on your behalf (sending emails, making calls, updating records). You are responsible for configuring appropriate guardrails and reviewing automated actions.
- Voice AI: Phone calls handled by our AI voice agents are conducted by artificial intelligence. Call recipients will be informed that they are speaking with an AI system.
4. Subscriptions & Billing
- Subscription plans are billed monthly or annually as selected at checkout.
- Payments are processed securely through Stripe. We do not store your payment card details.
- Subscriptions automatically renew unless canceled before the next billing cycle.
- You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
- Refunds are handled on a case-by-case basis. Setup fees are non-refundable.
- We reserve the right to change pricing with 30 days' written notice. Existing subscriptions remain at their current rate until renewal.
5. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party rights
- Send unsolicited communications (spam) through our outreach tools
- Misrepresent AI-generated communications as human-authored where disclosure is required
- Attempt to reverse-engineer, decompile, or extract our AI systems, prompts, or workflows
- Use the Services for any illegal, harmful, or fraudulent purpose
- Exceed usage limits defined by your subscription tier
- Share account credentials with unauthorized parties
6. Intellectual Property
- Our IP: All CGAI systems, workflows, AI configurations, system prompts, agent architectures, and platform technology are our proprietary intellectual property.
- Your data: You retain ownership of all data you provide to us. We are granted a limited license to use your data solely for the purpose of delivering the Services.
- Generated content: Content generated by our AI systems for your business use is licensed to you for the duration of your subscription. You may use it for your business purposes.
7. Data & Confidentiality
We take data protection seriously. Client business data is treated as confidential and is not shared with other clients. Anonymized, aggregated data may be used to improve our services and develop industry benchmarks. For full details, see our Privacy Policy.
8. Service Level & Availability
- We target 99.9% uptime for our core services but do not guarantee uninterrupted availability.
- Scheduled maintenance will be communicated in advance when possible.
- We depend on third-party services (Anthropic, ElevenLabs, Twilio, etc.) and are not liable for their outages.
- Enterprise clients may negotiate specific SLA terms under separate agreements.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CGAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless CGAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms, non-payment, or other cause, with notice when practicable. Upon termination, you may request export of your data within 30 days. After 30 days, we may delete your data.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance.
